An Act To Amend Title 11 Of The Delaware Code Relating To The Classification Of Offenses And Sentences. [HB-338]
This Act authorizes a sentencing court to modify, defer, reduce or suspend a minimum or mandatory sentence of one year of less if it finds the person to be sentenced has serious and ongoing medical treatment needs which make incarceration inappropriate and that the person does not pose a substantial risk to the community. The Department of Corrections has authority (11 Del. C. 4217) to request the modification of an inmate’s sentence based on medical illness or infirmity. An Act To Amend Title 29 Of The Delaware Code Relating To Libraries. [HB-340]
This Act enables Delaware’s public libraries to respond to expanding demand for and use of wireless and mobile technologies while clarifying that the use of such devices is subject to the Delaware Children’s Internet Protection Act. The Act furthers the goal of protecting minors from viewing obscene materials on the Internet by requiring libraries to post notices advising patrons to follow acceptable use policies and place appropriate controls on personal mobile and computing devices. An Act To Amend Title 14 Of The Delaware Code Relating To The Mandatory Reporting Of School Crimes. [HB-347]
This Act implements recommendations of the Legislative Subcommittee of the School Discipline Task Force created by House Resolution No. 22 of the 145th General Assembly. Under current Delaware law, school officials have a mandatory obligation to report to the police and, in certain instances, initiate criminal prosecution of specific misdemeanor offenses (Assault in the 3rd Degree, Unlawful Sexual Contact in the 3rd Degree, Offensive Touching and Terroristic Threatening) committed by students over the age of 9. This Act would raise the age to 12.

An Act To Amend Title 14 Of The Delaware Code Relating To Parental Involvement In Schools. [HB-350]
Section 1 of this bill would require schools to seek the signature from each parent of a parent/school compact at the beginning of each school year, reflecting an updated Parents’ Declaration of Responsibilities to be prepared by the State and parent organizations. Existing law encourages, but does not require, that parents be asked to sign such a compact. This Act creates the Delaware Aging and Disability Resource Center within the Division of Services for Aging and Adults with Physical Disabilities of the Department of Health and Social Services, replacing the current Elder Care Information and Support System for Delaware Families. This Bill clarifies the role of the Community Legal Aid Society, Inc. (CLASI), designated for the past 30 years as Delaware’s Protection and Advocacy Agency pursuant to federal law, in protecting patients and residents in nursing and similar facilities. As a complement to the existing protective system operated by the Department of Health and Social Services, CLASI is authorized to solicit and investigate reports of abuse, neglect, mistreatment and financial exploitation in covered facilities.
