An Act To Amend Title 10 Of The Delaware Code Relating To Levying Upon Goods In A Storage Warehouse [HB-244]
The development of portable storage units that may be placed upon an individual’s property has called into question whether these units are, in fact, “storage warehouses” and whether a constable may levy upon property located within. This legislation clarifies that portable storage containers are not storage warehouses and, therefore, the property located within is not exempt from levy and sale. It also eliminates the personal penalty directed to a constable who violates this section.

This bill amends the Delaware Code concerning commerce and trade by during a declared state of emergency and shortly thereafter prohibiting the unjustified overpricing of gasoline which is essential to the promotion of the general health, safety and welfare. Specifically, an increase of over 10% beyond the pre-emergency price shall be prohibited as excessive.

An Act To Amend Chapter 65, Title 11 Of The Delaware Code Relating To The Employment And Payment Of Personnel By The Department Of Correction. [HB-264]
This Bill will enable the Department of Correction to offer casual seasonal employment for up to 6 months to ex-offenders who demonstrate exceptional job skills while enrolled in a Level 4 or Level 5 vocational program, notwithstanding any prior felony convictions. This Bill also makes certain changes to the Department’s existing application and review processes to conform to existing practices. The ex-offender program contemplated in this Bill will be funded exclusively by the Delaware Correctional Industries Special Fund.

An Act To Amend Title 21 Of The Delaware Code Relating To Motor Vehicle Dealers. [HB-266]
New motor vehicle dealers have been performing safety and VIN verifications on vehicles 5 model years old or newer since 2011. This legislation would allow any licensed dealer approved by the department to perform VIN verifications. This authorization does not relate to emissions inspections, which are not currently required for models 5 years old or newer. Emissions testing is done by the State of Delaware. This Act would allow, by a reduction in volume, increased customer service and provide shorter wait times for others at designated inspection

This bill makes it a crime to operate or attempt to operate a clandestine laboratory defined as any location on or in which a person assembles any chemicals or equipment which are intended to be used to or have been used to unlawfully manufacture a controlled substance or other substance in violation of the Uniform Controlled Substance Act. An Act To Amend Title 21 Of The Delaware Code Relating To Arrest Without Warrant For Motor Vehicle Violations. [HB-280]
Delaware law enforcement agencies are currently limited to making arrests for cell phone and seatbelt violations to only when the offense occurs in the presence of the police officer. This bill adds these two violations to Title 21, Chapter 7, 701 along with speeding and red light violations as offenses where an arrest is permissible when an observing officer relays the violation information to another officer and is in a position to verify that the appropriate vehicle was stopped.
