This bill amends section 2306 of Delaware’s probate code as it relates to distribution of the decedent’s personal estate without the grant of letters by the Register of Wills when the decedent’s personal estate is valued at less than $30,000 (“the small estate affidavit”). This bill (1) adds the named executor in a decedent’s will to the category of those persons eligible to distribute the decedent’s personal estate without the grant of letters, and (2) lists the named executor as having the first priority among those persons eligible to distribute

An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-304]
This bill provides that a person who stands in a position of trust, authority or supervision over a child who is at least 16 years old but not yet 18 years old and intentionally engages in sexual intercourse or sexual penetration with such child or an invitee or designee of such person shall have committed the offense of Rape in the 3rd degree which is a class B felony. This offense is currently Rape in the 4th degree which is a class C felony.

An Act To Amend Title 18 Relating To Captive Insurance Companies. [HB-314]
This legislation amends chapter 69 of title 18 of the Delaware Code by adding two types of captive insurance companies to those that can currently be licensed in Delaware. The two new forms of captive insurance companies are “agency captive insurance companies” and “branch captive insurance companies.” Agency captive insurance companies are reinsurance companies owned by insurance agents or brokers who underwrite and place insurance policies for conventional insurance companies.
