An Act To Amend Title 16 Of The Delaware Code Relating To Mental Health. [SB-221]
This Bill updates the statute that allows the Division of Developmental Disabilities Services to authorize surgical procedures for persons receiving residential services from the Division. It expands the range of potentially available relatives to authorize elective surgery for persons receiving services from the Division of Developmental Disabilities Services. It expands the scope of the authorization to diagnostic procedures and corrects the statutory definition of who is covered by this law.

An Act To Amend Title 11 Of The Delaware Code Relating To Crimes Against Children And Specific Offenses. [SB-229]
This Act implements one of the recommendations made in the Final Report of the Independent Review of the Earl Brian Bradley Case which was commissioned by the Governor and was issued on May 10, 2010. The Act clarifies who is in a “position of trust, authority or supervision over a child” and may therefore be subject to the enhanced penalties associated with the crimes defining sexual abuse of children. This Bill is the Delaware Prescription Monitoring Program Act. It provides for the establishment of a program for the monitoring of prescribing and dispensing Schedule II, III, IV, or V controlled substances and other drugs of concern by the Office of Controlled Substances of the Division of Professional Regulation. An Act To Amend Title 24 Of The Delaware Code Relating To Private Investigators, Private Security Agencies And Bail Enforcement Agents. [SB-246]
This Bill creates a Delaware Board of Examiners of Bail Enforcement Agents empowered to enforce standards upon bail enforcement agents. This 9 member board will supplant the primary responsibility of the Secretary of the Department of Safety and Homeland Security regarding licensure and disciplinary regulatory authority. Regulations proposed by the Board would still be subject to the approval of the Secretary. The Bill also requires that licensees operating a bail enforcement company obtain insurance and file proof of insurance with the Board.
