It is the intent of the Legislature, in enacting this Bill, to encourage the use of reusable bags by consumers and retailers and to reduce the consumption of limited use plastic carryout bags that require massive quantities of oil, cause countless pollution, and, as such bags decompose, are harmful to the health of the environment and humans. This Bill would require a store, as defined, to establish an at-store recycling program that provides an opportunity for a customer of the store to return clean plastic carryout bags to that store. This Bill repeals mandatory minimum sentences in Title 16 relating to violations of our drug laws, returning to our State’s outstanding judiciary the discretion to pronounce sentences appropriate to the cases and individuals before them. Delaware’s sentencing guidelines and Truth-in-Sentencing Law will remain in force, helping to guide judges in their decisions and ensuring offenders’ completion of their sentences. An Act To Amend Titles 10 And 11 Of The Delaware Code Relating To Records Of Arrest And Prosecution. [HB-169]
This Act eliminates the five-year waiting period for a person who has successfully completed the Probation Before Judgment (“PBJ”) program, and the two-year waiting period for a person who has successfully completed the First Offenders Controlled Substances Diversion Program (“CSDP”), to obtain an expungement of the arrest and conviction records relating to that offense. This Act clarifies that offenses for which records have been expunged do not have to be disclosed as arrests. This Act also corrects for what appear to be inadvertent omissions

This bill makes a series of amendments to Chapter 44, Title 18 of the Delaware Code with the intent of implementing changes to the Delaware Life And Health Insurance Guaranty Association Act to ensure in a liquidation of a life and/or health insurance company licensed in Delaware that procedures are in place to ensure an organized liquidation of such company with the appropriate protections for the policyholders of such company.
