An Act To Amend Title 29 Of The Delaware Code Relating To State Recognition Of The Lenape Indian Tribe Of Delaware. [HB-345]
Under this Act, the General Assembly formally recognizes the Lenape Indian Tribe of Delaware ("the Tribe") as an American Indian tribe, not only to acknowledge the Tribe's rich history and culture, but also so that the Tribe may be recognized as eligible for the programs and services that the United States provides to Indians because of their status as Indians. An Act To Amend Title 14 Of The Delaware Code Relating To Educator Licenses. [HB-350]
This Act revises the Delaware Code relating to the limitation, suspension and revocation of educator licenses. Between September 2012 and September 2014, the Delaware Department of Education has investigated 105 cases of alleged educator misconduct, recommending revocation in 12, suspension in 10 cases, and limitation in 1 case. An Act To Amend Title 25 Of The Delaware Code Relating To Property. [HB-353]
This bill eliminates the requirement that a mortgage be under seal in order for it to be enforced through a foreclosure proceeding in the Superior Court pursuant to Chapter 49 of Title 10. The under seal requirement is most prominently described in the case of Monroe Park v. Metropolitan Life Ins. Co., 457 A.2d 734, 736 (Del. 1983) (“[I]t is well settled that unless the seal requirement is abolished by statute, a mortgage must be under seal to be enforceable at law.”). An Act To Amend Titles 14, 16, And 29 Of The Delaware Code Relating To The Able Program, The Delaware College Investment Plan, And The Deferred Compensation Plan. [HB-358]
This Act will merge the oversight of three different state-sponsored investment plans that hold non-state monies into a single new “Plans Management Board”. An Act To Amend Title 6 Of The Delaware Code Relating To Funds Transfers. [HB-364]
The Electronic Funds Transfer Act (“EFTA”) was originally drafted to govern only consumer wire transfers. As a result, 4A-108 of Title 6 of the Delaware Code excluded fund transfers governed by EFTA from the scope of Article 4A of Title 6 (“Article 4A”). However, in 2010, the Dodd-Frank Wall Street Reform and Consumer Protection Act amended EFTA (“Dodd-Frank amendments”) to bring remittance transfers that are electronic fund transfers within its scope.
