This act deletes antiquated code provisions requiring churches and religious organizations to obtain a permit from a commission (composed of the Sheriff, County Council President and Clerk of the Peace of each respective county) to conduct camp meetings and outdoor religious meetings.

An Act To Amend Title 16 And Title 29 Of The Delaware Code Relating To Health And Safety And Duties Of The Attorney General. [HB-353]
This bill, a.k.a. the Delaware Health Care Freedom Act, clarifies that only the State of Delaware has the legal authority to regulate private healthcare insurance, systems, plans, and services within its borders. The bill specifies and guarantees that Delawareans are, and shall be, free to choose or decline to choose any mode of securing health care services without penalty or threat of penalty. An Act To Amend Title 7 Of The Delaware Code Relating To Environmental Control. [HB-355]
This Bill requires an expedited authorization process for the replacement or rebuilding of docks, piers, or bulkheads when they are being rebuilt on the existing or previously existing structural footprint. If the Secretary wrongfully denies such application the State shall be liable for the applicant’s reasonable attorney fees and expenses. The State’s immunity to liability is expressly waived.

An Act To Amend Title 29 Of The Delaware Code Relating To Limiting The Authority Of Public Bodies To Regulate Arms. [HB-357]
This new chapter is intended to address the banning of possession of firearms by certain governmental agencies and entities of the State. Currently, several housing agencies in this state have adopted policies of evicting or threatening to evict law abiding tenants from their homes merely for the otherwise lawful possession of firearms for self-defense. This practice constitutes discrimination based on economic circumstances leaving these residents at the mercy of criminals.

This Bill clarifies the role of the Community Legal Aid Society, Inc. (CLASI), designated for the past 30 years as Delaware’s Protection and Advocacy Agency pursuant to federal law, in protecting patients and residents in nursing and similar facilities. As a complement to the existing protective system operated by the Department of Health and Social Services, CLASI is authorized to solicit and investigate reports of abuse, neglect, mistreatment and financial exploitation in covered facilities. An Act To Amend Title 29 Of The Delaware Code Relating To Certain Positions In The Court Of Common Pleas. [HB-365]
This legislation designates the upper-level management positions in the Court of Common Pleas from classified service to exempt service, consistent with similar positions in the Superior Court and the Family Court. An Act To Amend Title 16 Of The Delaware Code Relating To Fire Prevention. [HB-376]
This Act updates Delaware’s Fire Prevention Regulations to require installation of floor proximity emergency lighting and floor proximity exit signs in all new buildings, occupancy conversions, mixed occupancy buildings and additions and repairs to existing buildings. Floor Proximity Exit Signs shall be installed in addition to exit signs currently required under Delaware’s Fire Prevention Regulations.

An Act To Amend Title 24 Of The Delaware Code Relating To Licensure For Plumbing Contractors And Heating, Ventilation, Air Conditioning, And Refrigeration Contractors [HB-377]
This bill addresses an inequity in licensing procedures for out of state contractors in the plumbing and heating, ventilation, air conditioning and air refrigeration (“HVACR”) fields. Currently a licensed contractor from any state can obtain a Delaware plumbing or HVACR license by simply paying a fee and proving that the contractor is licensed elsewhere. Some states do not offer the same reciprocity, and instead require Delaware contractors take a written test, pay a fee, and satisfy all licensing criteria for that state.
