An Act To Amend Title 25 Of The Delaware Code Relating To Liens. [HB-258]
This bill simplifies the procedures for selling a vehicle to satisfy a lien. Under the current law, a garagekeeper must institute a proceeding in a Justice of the Peace Court for permission to hold a sale for every vehicle for which the owner does not pay the repair bill. If this bill is enacted, the owner and all those with a security interest in the vehicle will be provided notice of the garagekeeper’s intent to sell the vehicle and the owner or other person must affirmatively apply to the Justice of the Peace Court within 60 days for a hearing.

An Act To Amend Title 21 Of The Delaware Code Relating To Off-highway Vehicles. [HB-259]
This Act clarifies the enforcement of Delaware’s driving under the influence statute as it relates to the operation of off-highway-vehicles. Title 21, 4177(c)(4), defines the term “vehicle” to include “any off-highway vehicle as defined in 101(39) of this title” and, but for Title 21, 6833, would allow application of the DUI statute to a person who operates an OHV while under the influence. The provisions of Chapter 68 (Registration and Control of Off-Highway Vehicles) apply in the event that there are conflicts between statutes and Title 21,

An Act To Amend Title 29 Of The Delaware Code Relating To Hazardous Duty Pay. [HB-262]
This Bill provides that employees serving in security-related or high-risk positions may be eligible for hazardous duty pay. Those positions would be designated by the Chief Justice in accord with the needs of each court. Funding for this additional pay would come from the Court Security Fund, established by 10 Del. C. 8505.

This Bill removes a provision by which either the Chief Justice of the Supreme Court or the Deputy Administrator for the Justice of the Peace Court was required to verify the final disposition of a case before a previously paid fine could be refunded. This Bill changes the practice in the Justice of the Peace Court to mirror that of the Court of Common Pleas, allowing the court clerk, subject to the internal controls now in place in the Court, to verify the final disposition of a case when a fine should be refunded.

An Act To Amend Title 14 Of The Delaware Code Relating To School Bullying. [HB-268]
This bill requires that all reported incidents of bullying regardless of whether the incidents could be substantiated are reported to the Department of Education by a school district or charter school. The bill also requires that the telephone number of the Department of Justice School Ombudsman be provided to parents, students, faculty and staff and be displayed throughout schools.
