Modeled on legislation adopted by other states, this Act adopts a “Military Parents’ Rights Act” to provide military service members with certain substantive rights and procedural protections designed to ensure that an absence due to military deployment does not result in a forfeiture or diminution of the military parent’s custody or visitation rights. An Act To Amend Title 18 Of The Delaware Code Relating To Health Insurance [HB-420]
This Act is intended to prohibit the practice of “post-claims underwriting” by health insurers, as defined in Title 18 of the Delaware Code. Underwriting is the practice of determining, based upon information provided by an applicant for an insurance policy about the applicant’s health and background, whether the insurance company should offer the applicant a policy and, if so, what should be the terms and the cost of the policy. An Act To Amend Title 6 Of The Delaware Code Relating To Consumer Legal Finance Transactions. [HB-422]
This Act adopts the “Delaware Consumer Legal Finance Regulatory Act” to ensure protections for individuals who enter into consumer legal finance contracts. A consumer legal finance transaction is one in which person assigns a contingent right to receive an amount of the potential proceeds of their legal claim to Consumer Legal Finance Company in exchange for money. An Act To Amend Title 24 Of The Delaware Code Relating To Pawnbrokers, Secondhand Dealers And Scrap Metal Processors. [HB-430]
This act requires scrap metal processors to photograph every seller and report every transaction relating to certain metals. Currently only transactions valued at $250 or more must be reported. Multiple sellers bring in metal items with no one selling $250 and therefore they avoid the reporting requirement. With the current rash of copper thefts this bill will increase reporting and increase the ability to identify sellers.
