This Bill requires an expedited authorization process for the replacement or rebuilding of docks, piers, or bulkheads when they are being rebuilt on the existing or previously existing structural footprint. If the Secretary wrongfully denies such application the State shall be liable for the applicant’s reasonable attorney fees and expenses. The State’s immunity to liability is expressly waived.

An Act To Amend Title 29 Of The Delaware Code Relating To Limiting The Authority Of Public Bodies To Regulate Arms. [HB-357]
This new chapter is intended to address the banning of possession of firearms by certain governmental agencies and entities of the State. Currently, several housing agencies in this state have adopted policies of evicting or threatening to evict law abiding tenants from their homes merely for the otherwise lawful possession of firearms for self-defense. This practice constitutes discrimination based on economic circumstances leaving these residents at the mercy of criminals.

An Act To Amend The Laws Of Delaware Volume 66, As Amended, Pertaining To The Charter Of The Town Of Clayton. [HB-362]
This Act is designed to update the Clayton Town Charter. During a February 2009 Federal Motor Carrier Safety Administration (FMCSA) commercial driver license (CDL) program compliance review, Delaware was found out of compliance for lacking the specific statutory authority to impose certain federally regulated CDL program requirements. This housekeeping bill statutorily brings Delaware into compliance with federal CDL regulations.

An Act To Amend Title 16 Of The Delaware Code Relating To Fire Prevention. [HB-376]
This Act updates Delaware’s Fire Prevention Regulations to require installation of floor proximity emergency lighting and floor proximity exit signs in all new buildings, occupancy conversions, mixed occupancy buildings and additions and repairs to existing buildings. Floor Proximity Exit Signs shall be installed in addition to exit signs currently required under Delaware’s Fire Prevention Regulations.

An Act To Amend Title 16 Of The Delaware Code Relating To Controlled Substances [HB-382]
This bill corrects an error in the Delaware Code provision relating to the sale of pseudoephedrine or ephedrine. The law currently provides that a licensed pharmacist, sales clerk or “licensed pharmacy technician” shall require that any person purchasing, receiving, or otherwise acquiring any substance containing pseudoephedrine or ephedrine shall be age 18 or older and show a photo ID. The law requires pharmacists, sales clerks and “licensed pharmacy technicians” to check for ID and to maintain a written log of all pseudoephedrine or ephedrine
