This bill increases the penalties for carrying a concealed deadly weapon, when the weapon is a firearm, by reclassifying what is currently a class G felony as a class D violent felony. The bill also deletes a penalty provision that is unnecessary and duplicative, since any person previously convicted of a violation of section 1442 is also a person prohibited under section 1448 of Title 11. Furthermore, the bill makes corresponding changes to other statutes.

This bill grants the Board of Pharmacy authority to establish standards and procedures for the collection, destruction, return and redistribution of previously dispensed medications. The drug collection program must comply with all applicable local, State and Federal laws and regulations.

This bill is a total rewrite of the special election chapter. It provides that the officer issuing the writ do so within 10 days of the vacancy, that he/she sets the date of the special election not less than 30 nor more than 35 days following the issuance of the writ, establishes a nomination deadline of 25 days prior to the date of election, provides for unaffiliated candidates, establishes requirements for notices, and otherwise updates the chapter.

An Act To Amend Title 11 Of The Delaware Code Relating To Licenses To Carry Concealed Deadly Weapons. [HB-258]
This Act increases, from $34.50 to $65.00, the filing fee assessed by the Superior Court in connection with an application for a license to carry a concealed deadly weapon. The Act also extends the term of validity for new licenses from 2 to 3 years and the term of validity for renewal licenses from 3 to 5 years. Increasing the fees for licenses, as well as the period for which such licenses are valid, will enhance efficiency and preserve resources by reducing the frequency with which the Superior Court and Attorney General’s Office must allocate

An Act To Amend Title 26 Of The Delaware Code Relating To The Standard Used For Cost Recovery For Public Utilities In Proceedings Involving A Change In Rates. [HB-277]
This amendment specifies that the standard for assessing whether and to what extent any amount that a public utility seeks to include in its rate base or operating expenses for ratemaking purposes is the “prudent person” standard. This amendment supersedes the Delaware Supreme Court’s opinion in Delmarva Power & Light Company v. Public Service Commission and Application of Wilmington Suburban Water Company, in which the Court established the standard for allowance of all utility expenses for ratemaking purposes as “waste, bad faith or abuse of discretion.”
