This Act affirmatively authorizes preexisting common interest communities and approved common interest communities to comply with any or all of the provisions of the Delaware Uniform Common Interest Ownership Act that they are not already required to comply with. This Act may be cited as the Benjamin Kuntz Act. A dedicated Delawarean who spent countless hours chairing the Kent County Levy Court’s Homeowners Associations Resolving Problems (HARP) Committee. He advocated tirelessly for homeowner associations.

An Act To Amend Title 16 Of The Delaware Code Relating To The Volunteer Firemen's Pension Plan. [SB-53]
This bill clarifies that a participating volunteer fire company or ladies auxiliary in the Delaware Volunteer Firemen’s Pension Plan has the ability to withdraw from the plan. As part of that withdrawal process the company or auxiliary would pay a withdrawal liability payment that would be used to pay the retirement benefits of their member’s accrued benefits and ensure the actuarial soundness of the Fund for the remaining Employers.

An Act To Amend Title 29 Of The Delaware Code Relating To Right-to-work Zones And The Gross Receipts Tax. [SB-54]
This Act allows the Director of the Delaware Economic Development Office to create right-to-work zones as part of its inducements to bring new businesses to Delaware and requires these zones to be offered for manufacturing businesses hiring at least 20 employees. It also exempts those manufacturing businesses from their gross receipts taxes for their first 5 years.

An Act To Amend Titles 11 And 21 Of The Delaware Code Relating To Temporary Instruction Permits And Drivers Licenses. [SB-59]
This Act creates the means for an undocumented immigrant to apply for and obtain valid driving privileges in the State of Delaware. Those who are eligible will be issued a Class D driver license for driving privileges only that is not considered a valid form of identification due to the applicant’s inability to prove legal presence in the United States. The driving privilege card will be uniquely designed to distinguish it from other driver licenses. It will also be clearly marked “Not Valid for Identification” and for “Driving Privileges Only”.

An Act To Amend Title 18 Of The Delaware Code Relating To Port-of-entry For Foreign Insurance Companies. [SB-87]
This bill creates a Port-of-Entry chapter for the Delaware Insurance Code. This will allow international insurance companies to use Delaware as its “Port-of-Entry” state into the U.S. market. This bill gives the Insurance Commissioner the authority to regulate these entities and sets up the requirements and other regulatory framework for them to come to Delaware.

An Act To Amend Title 16 Of The Delaware Code Relating To Medical Marijuana. [SB-90]
This Act adds intractable epilepsy to the list of debilitating medical conditions for which a physician may supply a written certification for medical marijuana. It also specifically adds disorders such as dystonia which are characterized by involuntary muscle contractions that cause slow, repetitive movements or abnormal postures. Currently no form of medical marijuana is legally available for those with debilitating medical conditions if they are under 18 years old. Establishing The Delaware Economic And Financial Council Advisory Council On Spending. [SCR-13]
Delaware is the 4th most expensive state per capita in the country. This Senate Concurrent Resolution establishes a DEFAC Advisory Council on Spending to evaluate the spending aspect of the state’s budget. The DEFAC Advisory Council on Revenue was created by Executive Order 47 and neglects to study how state revenue is being spent. In order to adequately research the condition of the budget, it is imperative that we not only examine revenue sources but also how that revenue is spent.
