This Bill repeals mandatory minimum sentences in Title 16 relating to violations of our drug laws, returning to our State’s outstanding judiciary the discretion to pronounce sentences appropriate to the cases and individuals before them. Delaware’s sentencing guidelines and Truth-in-Sentencing Law will remain in force, helping to guide judges in their decisions and ensuring offenders’ completion of their sentences. An Act To Amend Titles 10 And 11 Of The Delaware Code Relating To Certain Offenses. [HB-182]
This bill provides the Family Court with discretion to determine whether it is appropriate to designate juvenile offenders who are under age fourteen on the date of the offense or who were over age fourteen on the day of the offense but did not commit one of the offenses enumerated in 771-78 of Title 11 (for which registration is required pursuant to the federal Adam Walsh Act) as sex offenders, thus subjecting them to the registration and reporting requirements under Delaware law. An Act To Amend Title 4 Of The Delaware Code Relating To Licensing Fees. [HB-210]
This Bill would change the license fees of licenses to sell alcoholic liquors which have remained the same since 1955. In addition to modernizing the fees, the Bill will require all licensees that wish to sell alcoholic liquors on Sunday to pay an additional fee. Currently taprooms, taverns, farm wineries, and package stores are not required to pay an additional fee while other licensees are.

An Act To Amend Chapter 53, Title 30 Of The Delaware Code Relating To The Levy, Collection And Use Of Tobacco Product Tax Revenue. [HB-211]
This Act increases the tax on cigarettes from $1.15 to $1.60 per 20-cigarette pack. Section 1 increases the cigarette tax rate. Section 2 makes the cigarette tax effective for possession within the state after midnight July 31, 2009. It also imposes a “floor tax” on inventories of cigarettes and requires that the difference between the new tax and the old tax be paid on stamps purchased on or before midnight July 31, 2009, but not affixed to any cigarettes as of the effective date of this Act.
