Chapter 98 of Title 10 sets, by statute, all fees chargeable in the Justice of the Peace Court. The fees of all other courts in the State of Delaware are set by court rule, subject to approval by the Chief Justice and the Delaware Supreme Court. Currently, if a fee in that Court needs to be modified for any reason, the General Assembly must take it up as an amendment to the statute. An Act To Amend Title 25 Of The Delaware Code Relating To Solar Photovoltaic Systems And Amendments To Deed Restrictions. [SB-49]
This Bill enables the use of rooftop solar systems on privately owned residential dwellings by limiting the use of covenants or other restrictions beginning January 1, 2010 but does not impact restrictions in effect prior to then . This bill also permits any deed restrictions which are silent as to how they may be amended may hereafter be amended by a vote of no more than 75% of the property owners. Restrictions concerning solar collectors on roofs may be amended by two-thirds of the property owners.

An Act To Amend Title 14 Of The Delaware Code Relating To Student Assessment And Academic Promotion. [SB-68]
This legislation eliminates the DSTP, and requires its replacement beginning in the 2010-2011 school year with a test administered at a minimum in each grade level 2 through 10 at the beginning of the school year and at least one more time later in the year, to assess student progress over the course of the year as well as providing a benchmark for student, school, and district achievement. This new testing regimen will allow a student’s performance on state assessments to be based upon the student’s best results from the multiple assessments performed

An Act To Amend Titles 10 And 29 Of The Delaware Code Relating To Real Property Acquisition And Eminent Domain. [SB-7]
This Bill requires state, county, or municipal governments, or State agencies or other condemning entities to use their eminent domain authority solely for “public use” and defines that term. The Bill specifically states that benefits derived from economic development do not constitute a public use. The Bill also includes notice to property owners of the asserted public use and this policy. An Act To Amend Title 10 Of The Delaware Code Relating To Judges Of The Superior Court. [SB-71]
Current Delaware Code limits the number of Superior Court Judges to 19 (14 judges in addition to the President Judge and the 4 judges required by Article IV, 2 of the Constitution). This legislation would allow for, but not require, the addition of 2 Superior Court Judges, consistent with the FY 2009 Budget Act. This legislation would have no immediate fiscal impact, as the filling of any new judgeships would be contingent upon the appropriation of funding for those positions on a continuing basis by the Governor and the General Assembly, as well

This bill would require that one of the parents or approved sponsor of a person enrolled in a Delaware driver education course must attend a Graduated Driver License (GDL) Parent Orientation Program before being issued the Department of Education’s blue certificate.
