An act to amend the agriculture and markets law, the county law and the tax law, in relation to granting partial deduction of interest income in the calculation of the franchise tax on business corporations and the personal income tax involving certain sales of land used in the production of fruit or fruit products [AB-3138]
This bill grants to fruit growers or other land owners that sell orchards, vineyards, and other fruit producing lands to other farmers who plan to keep acreage in production a deduction from their income taxes a portion of the interest that is earned from the loan issued by the selling landowner to the buying farmer. Land that is covered under this program would need to grant a conservation easement to ensure that such lands remain in agricultural production.
