An Act To Amend Title 10 Of The Delaware Code Relating To Reporting Financial Exploitation Of The Elderly And Infirm. [HB-302]
This bill is intended to encourage the reporting of suspected financial exploitation of the elderly and infirm adults by providing immunity from criminal and civil liability for making such reports. Under the bill, anyone who makes a good faith report to law enforcement authorities of such suspected activity is immune from criminal and civil liability for making that report. An Act To Amend Title 11 Of The Delaware Code Relating To Specific Offenses. [HB-304]
This bill provides that a person who stands in a position of trust, authority or supervision over a child who is at least 16 years old but not yet 18 years old and intentionally engages in sexual intercourse or sexual penetration with such child or an invitee or designee of such person shall have committed the offense of Rape in the 3rd degree which is a class B felony. This offense is currently Rape in the 4th degree which is a class C felony.

An Act To Amend Titles 3, 11 And 29 Of The Delaware Code Relating To The Operation Of Table Games By The Delaware Lottery, The Creation Of A Division Of Gaming Enforcement Within The Department Of Safety And Homeland Security, Licensing Of Video Lottery Agent Personnel And Lottery And Agent Vendors, Prohibition On Gaming By Certain Persons, The Creation Of A Lottery Commission, And The Number Of Harness Racing Days. This bill authorizes the introduction and operation of table games by the Delaware Lottery at licensed video lottery agents. Like the video lottery, the table games would be offered on the premises of Delaware's video lottery agents. The Delaware Lottery would determine which table games would be played and establish regulations for the effective management of the games. An Act To Amend Title 18 Relating To Captive Insurance Companies. [HB-314]
This legislation amends chapter 69 of title 18 of the Delaware Code by adding two types of captive insurance companies to those that can currently be licensed in Delaware. The two new forms of captive insurance companies are “agency captive insurance companies” and “branch captive insurance companies.” Agency captive insurance companies are reinsurance companies owned by insurance agents or brokers who underwrite and place insurance policies for conventional insurance companies. An Act To Amend Title 10 Of The Delaware Code Relating To Constable Sales. [HB-324]
This Act eliminates a reference to a code section which no longer regulates court costs in the Justice of the Peace Court costs. Legislation passed earlier in the 145th General Assembly (Senate Bill No. 37) authorized the Justice of the Peace Court to establish court costs by court rule, subject to the approval of the Chief Justice.

Consistent with Delaware’s Child Victim’s Act, this Act clarifies that civil actions based on sexual abuse of a patient by a healthcare provider may be filed at any time after the commission of the abuse. This Act also creates a 2-year “look-back” provision in cases of abuse which was unknown and could not reasonably have been discovered by the patient.
