This Act provides for a 10-year extension to the Historic Preservation Tax Credit Act which is scheduled to expire in June 2010. Seventy-five (75) historic buildings throughout the State have been rehabilitated and preserved for future generations as a result of this program. Since its inception in 2001, the State has awarded $34 million in tax credits that have leveraged more than $166 million in private-sector rehabilitation expenditures plus additional tens of millions in site acquisition investments. An Act To Amend Title 13 Of The Delaware Code Relating To The Division Of Child Support Enforcement. [SB-213]
This Bill would allow the Division of Child Support Enforcement to disburse support payments electronically, either by direct deposit to a bank account or to a stored value card, instead of by mailing checks. Provision is made for exceptions to this practice where disbursing payments to the child support obligee by electronic transfer is not feasible.

An Act To Amend Title 11 Of The Delaware Code Relating To The Timing Of An Initial Hearing Before A Judge Of A Person Who Is Temporarily Incapacitated. [SB-217]
This Act codifies much of the current local practice by the police and the Justice of the Peace Court when handling defendants who are under the influence of alcohol or drugs or who have to be hospitalized at the time of arrest on serious charge and are unable to appear for presentments. For those defendants who are hospitalized, the transfer of custody provided for in this Bill allows the arresting officer to return to patrol or other public safety duties in a more timely manner, while allowing the defendant access to bail.

An Act To Amend Title 10 Of The Delaware Code Relating To Execution Of A Chattel Judgment. [SB-220]
This Bill Makes 9552 of Title 10, relating to Justice of the Peace Court civil judgment execution procedures, consistent with similar provisions applicable to Superior Court execution found in 5081 of the same title. Under this provision goods levied upon for the purpose of conducting a sale to satisfy all or part of a civil judgment remain available for three years. The duration of the lien or levy on chattel goods should be consistent in both the Justice of the Peace Court and Superior Court because the life of a money judgment is 5 years in both

This Bill updates the statute that allows the Division of Developmental Disabilities Services to authorize surgical procedures for persons receiving residential services from the Division. It expands the range of potentially available relatives to authorize elective surgery for persons receiving services from the Division of Developmental Disabilities Services. It expands the scope of the authorization to diagnostic procedures and corrects the statutory definition of who is covered by this law.

An Act To Amend Title 18 Of The Delaware Code Relating To Insurance. [SB-223]
Title 18 of the Delaware Code requires that an affidavit of merit be filed under seal when a lawsuit alleging medical malpractice is filed. This affidavit by plaintiff's expert witness is an opinion that the defendant has breached the applicable minimum standard of care and that this breach caused injury to the plaintiff.
