Section 1. Section 1 amends Section 102(a)(1) to enable the Division of Corporations in the Department of State to waive the requirement under Section 102(a)(1)(ii) in certain limited circumstances. Section 2. In ATP Tour, Inc. v. Deutscher Tennis Bund, 91 A.3d 554 (Del. 2014), the Delaware Supreme Court upheld as facially valid a bylaw imposing liability for certain legal fees of the nonstock corporation on certain members who participated in the litigation. An Act To Amend Title 14 Of The Delaware Code Relating To Educational Data Governance. [SB-79]
This bill amends Section 4111 of Title 14 of the Delaware Code to establish policies and procedures that enable school districts, schools, teachers, and school staff to collect and use student data for appropriate educational purposes while ensuring that the student data is kept safe and the privacy of students and their parents and guardians is protected. An Act To Amend Title 10 And Title 11 Of The Delaware Code Relating To Domestic Violence. [SB-83]
This Act makes several changes to Title 10 and Title 11 of the Delaware Code relating to domestic violence. First, this Act amends 1045, Title 10 relating domestic violence protective orders to clarify the procedures related to the disposition of firearms in the possession of a respondent. Second, this Act amends 1448(a)(6), Title 11 to provide that any person who is prohibited from purchasing, owning, possessing, or controlling a deadly weapon because the person is subject to a Family Court protection from abuse order is so prohibited immediately

An Act To Amend Title 29 Of The Delaware Code Relating To The Regulatory Flexibility And Transparency Act Of 2015. [SB-96]
The Regulatory Flexibility and Transparency Act of 2015 improves Delaware’s regulatory environment for individuals and small businesses in several significant ways. Under the Act, whenever an agency proposes to adopt or amend a regulation that is “substantially likely” to impose additional costs or burdens upon individuals and/or small businesses, that agency must prepare both a written regulatory flexibility analysis and a regulatory impact statement to be published by the Registrar of Regulations.
