This bill revises the procedure for impounding an animal which has allegedly been the subject of cruelty. The bill also creates a civil cause of action for Society for the Prevention of Cruelty to Animals to file suit against any person who engaged in cruelty to an animal. There is an express exemption from the ground of abandonment for releasing a cat as part of the Trap, Neuter and Release Program. Upon a finding of cruelty, the defendant is liable to the plaintiff for liquidated damages of $2,500 to cover the plaintiff’s litigation costs, as

Delaware’s Uniform Anatomical Gift Act (UAGA), was last updated in 1998. Since then, federal law and clinical practice surrounding organ and tissue donation has changed. To that end, the bill updates the provisions of existing Delaware law to provide consistency with federal law, ensure clinical best practices and to facilitate increased donor designation rates. This Act enables the prosecution of animal fighting under Delaware’s Racketeering and Organized Crime statute. Animal fighting is often linked to other forms of criminal activity, such as illegal drug distribution, gun running, prostitution, and other violent crimes. Including animal fighting in the definition of “racketeering” strengthens the ability of Delaware’s Department of Justice to prosecute those who abuse animals.

This Act extends the statute of limitations for certain civil claims relating to heinous human rights abuses to 10 years. It allows survivors more time to file claims for assault, battery, or wrongful death in Delaware state courts, provided their claims are based on acts of trafficking, genocide, torture, or crimes against humanity. Its intent is to ensure survivors get their rightful day in court by re-balancing the scales in a limited set of cases involving violations of fundamental human rights, where short filing deadlines currently favor abusers

An Act To Amend Title 29 Of The Delaware Code Relating To Compensatory Payments For Certain Exempt Properties Owned By The State. [HB-223]
This bill changes the program for distributing payments to cities with tax-exempt properties owned by the State. Instead of directing payments only to county seats (Wilmington, Dover, and Georgetown), the bill will authorize payments as well to any city with a population over 25,000 and more than 20% tax exempt property. It also raises the annual cap on the amount distributed by $500,000 and adjusts the formula under which these distributions are made.
