An Act To Amend Title 30, Title 16 Of The Delaware Code, And The Laws Of Delaware Relating To Nursing Homes And Quality Assessment. [SB-140]
In 2012, the General Assembly passed Senate Bill No. 227 which established the “Quality Assurance Fund” Fees collected under this legislation are placed into the Fund and are in turn matched by federal Medicaid dollars resulting in increased Medicaid reimbursement rates for long term care providers. This bill ensures assessment can go up to, but not exceed, maximum allowed under federal law as prescribed by CMS and repeals sunset date of December 31, 2018. Every indigent person accused of a crime has the Constitutional right to effective, conflict-free counsel funded by the state. In Delaware, the Public Defender's Office and the Office of Conflict Counsel are charged with the responsibility of providing counsel for indigent people accused of crimes. The Public Defender's Office is a publicly funded law firm representing about 83% of all indigent defendants in Delaware. This bill repeals the sunset provision included in Chapter 214, Volume 78 of the Laws of Delaware, which will continue to enable the Teach For America (TFA) program to recruit and train teachers from Delaware schools and from across the nation to teach in Delaware. This Act eliminates capital punishment, except for those convicted of first-degree murder before the effective date of this Act. The procedures for determining punishment, review of punishment, and method of punishment for first-degree murder related to capital punishment would still apply to those convicted of first-degree murder before the effective date of this Act.

An Act To Amend Title 10 Of The Delaware Code Relating To The Family Court Of The State Of Delaware. [SB-55]
This Bill extends the number of days for an emergency ex parte order from 10 days to 15 days. Currently, an ex parte order is issued and a full hearing is scheduled within 10 days. This can be insufficient time to effectuate service of the order and petition on the respondent. If respondent has not been served, the hearing is rescheduled and the petitioner must return to court the following week. Scheduling the hearings within 15 days will allow more time for service on the respondent, and afford more time for the parties to prepare for the hearing. (continued...)
