Relating To Concessions On Public Property. [SB-2108]
Increases the term of a concession from fifteen to twenty-five years and removes the requirement that certain concessions can only be awarded to nonprofit organizations. Provides that the director of parks and recreation of the respective county in their sole discretion to avoid vagueness in the present law should make certain decisions and designation. Exempts concessions on public property whose operations provide historical and cultural information, goods, and services within the State from bidding requirements. Takes effect 7/1/2050. (SD1)

Amends section 103D-307, Hawaii Revised Statutes, Emergency Procurements, to add equipment failures, repairs to public property to protect against further loss of, or damage to, public property, to prevent or minimize serious disruption in continued functioning of government services. Replaces Chief Procurement Officer approval with an accounting report to the Legislature within sixty days after the end of the fiscal year in which the procurement was made.

Allows the head of a purchasing agency to obtain emergency procurements in certain situations that create a threat to life, public health, welfare, public property, or serous disruption to government services, including situations caused by equipment failures. Replaces Chief Procurement Officer approval with an accounting report to the Chief Procurement Officer in a timely manner and to the Legislature within sixty days after the end of the fiscal year in which the procurement was made.
