JAFFEE -- read once and referred to the Committee on Local Governments AN ACT to amend the village law and the public officers law, in relation to permitting building inspectors, fire inspectors and code enforce- ment officers of the village of Airmont to live within Rockland county or adjoining counties The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The village of Airmont, Rockland county, has employed indi- 2 viduals that reside outside of the political subdivision or municipal 3 corporation as building inspector, fire inspector, and code enforcement 4 officer in violation of section 3 of the public officers law and section 5 3-300 of the village law. Notwithstanding this defect, the employment of 6 such individuals as building inspector, fire inspector, and code 7 enforcement officer is hereby validated, legalized, ratified and 8 confirmed, notwithstanding the absence of prior legislative approval. 9 § 2. Section 3-300 of the village law is amended by adding a new 10 subdivision 29 to read as follows: 11 29. Notwithstanding any provisions of this chapter or any other gener- 12 al law, local law, ordinance, or special act, the village board of trus- 13 tees of the incorporated village of Airmont, Rockland county, may, by 14 resolution, provide that the office of building inspector, fire inspec- 15 tor and code enforcement officers of such village may be held by a 16 person who is not a resident of such village, provided that such person 17 resides within Rockland county or an adjoining county within the state 18 of New York. 19 § 3. Section 3 of the public officers law is amended by adding a new 20 subdivision 68 to read as follows: 21 68. In the village of Airmont, in the county of Rockland, the 22 provisions of this section requiring a person to be a resident of the 23 political subdivision or municipal corporation of the state for which he EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. A. 5955 2 1 or she shall be chosen or within which his or her official functions are 2 required to be exercised, shall not prevent a person from holding the 3 office of building inspector, fire inspector and code enforcement offi- 4 cers of the village of Airmont, provided that such person resides within 5 Rockland county or an adjoining county within the state of New York. 6 Provided, however, the person performing the functions of building 7 inspector, fire inspector and code enforcement officers in any other 8 village shall be a resident of such village unless otherwise provided by 9 an act of the state legislature. 10 § 4. This act shall take effect immediately.
