By: Springer  S.B. No. 1802          (In the Senate - Filed March 7, 2023; March 20, 2023, read   first time and referred to Committee on Business & Commerce;   April 26, 2023, reported favorably by the following vote:  Yeas 11,   Nays 0; April 26, 2023, sent to printer.)Click here to see the committee vote     A BILL TO BE ENTITLED   AN ACT     relating to administrative procedures in the architectural   barriers program at the Texas Department of Licensing and   Regulation.          BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:          SECTION 1.  Section 469.058(a), Government Code, is amended   to read as follows:          (a)  The commission or executive director may impose an   administrative penalty under Subchapter F, Chapter 51, Occupations   Code, on a building owner for a violation of this chapter or a rule   adopted under this chapter.          SECTION 2.  Section 469.106(a), Government Code, is amended   to read as follows:          (a)  Notwithstanding any other provision of this chapter,   the commission shall require complete compliance with the standards   and specifications adopted by the commission under this chapter   that apply specifically to a building or facility occupied by a   state agency involved in extending direct services to persons with   mobility impairments. Those standards and specifications also   apply to a building or facility occupied by the Health and Human   Services Commission [Texas Rehabilitation Commission].          SECTION 3.  Section 469.058(c) and Section 469.059(c),   Government Code, are repealed.          SECTION 4.  The changes in law made by this Act do not affect   the validity of a disciplinary action or other proceeding that was   initiated before September 1, 2023, and that is pending on   September 1, 2023. A disciplinary action that is pending on   September 1, 2023, is governed by the law in effect immediately   before September 1, 2023, and the former law is continued in effect   for that purpose.          SECTION 5.  This Act takes effect September 1, 2023.     * * * * *
