A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §55-2-12a, relating to eliminating the statute of limitations for claims arising from certain sex related injuries.

Be it enacted by the Legislature of West Virginia:


ARTICLE 2. LIMITATION OF ACTIONS AND SUITS.


§55-2-12a. Personal actions for sexual assault, molestation, sex crimes, and sex trafficking.

Notwithstanding any provision in this code to the contrary, there shall be no statute of limitations for personal actions for damages for personal injuries arising from sexual assault, molestation, sex crimes, and sex trafficking.


 

NOTE: The purpose of this bill is to eliminate the statute of limitations for claims arising from certain sex related injuries.
